What Is an Expungement?

An expungement is a form of post-conviction relief. Expungements are authorized by the California Penal Code and serve to release an individual from all the penalties and disabilities arising out of a criminal conviction.

An expungement allows a defendant to withdraw a plea of guilty or no contest and re-enter a plea of not guilty. Then, they can have their case dismissed.

Who Is Eligible for an Expungement in California?

Expungements are available to defendants convicted of California misdemeanors or felonies. These defendants must:

  1. Successfully have completed probation for the offense; and
  2. Either did not serve time in state prison for the offense; or
  3. Served time in state prison but would have served time in the county jail had the crime been committed after implementing Realignment under Proposition 47.

Who Is Not Eligible for an Expungement in California?

A defendant may not currently be charged with a criminal offense, be on probation, or serving a sentence for a criminal offense to qualify for an expungement. Certain felony acts cannot be expunged, including:

  • Sodomy with a Child;
  • Oral Copulation with a child; and
  • Statutory Rape.

Those defendants not eligible for traditional expungement may seek relief through:

  • A Certificate of Rehabilitation;
  • Governor’s pardon; or
  • A commutation of a California prison sentence.
